Terms of Use (EULA)

These terms govern your use of the Water Eject mobile application. By installing or using the app you agree to them. If you do not agree, do not install or continue using the app.
1. License
Hermes Digital grants you a personal, non-transferable, non-exclusive, revocable license to install and use Water Eject on Apple-branded products you own or control, in accordance with the Apple Media Services Terms and Conditions and these terms.
You may not:
- Copy, modify, or create derivative works of the app.
- Reverse engineer, decompile, or disassemble the app except to the extent required by law.
- Rent, lease, sell, sublicense, distribute, or transfer the app to a third party.
- Remove, alter, or obscure any proprietary notices.
- Use the app to violate any applicable law.
2. Apple’s standard EULA
This license incorporates by reference the Licensed Application End User License Agreement published by Apple, with the following clarifications:
- The licensor is Hermes Digital, not Apple.
- Apple has no obligation to provide maintenance or support for the app. All support requests should be sent to support@watereject.app.
- In the event the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
- Hermes Digital is solely responsible for addressing any claims by you or any third party relating to the app or your use of it.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
3. In-app purchases
The app offers one optional in-app purchase: Water Eject Pro, a one-time non-consumable upgrade priced at $2.99 USD (price may vary by region). This unlocks additional features such as custom frequency, auto-repeat 3×, speaker test, and the Lock Screen widget. Purchases are processed by Apple through the App Store and are tied to your Apple ID.
Refunds for in-app purchases are handled by Apple at https://reportaproblem.apple.com. Hermes Digital cannot directly issue refunds for App Store transactions.
Pro is a one-time purchase, not a subscription. There is no recurring billing.
4. No warranties
The app is provided “as is” and “as available”, without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any specific result (including water removal) will be achieved.
Water Eject is a sound-based utility. It is not a substitute for proper drying or professional repair if your device has suffered severe water damage. Use the app at your own risk.
5. Limitation of liability
To the maximum extent permitted by law, Hermes Digital is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or in connection with your use of the app, even if advised of the possibility of such damages. Our total cumulative liability shall not exceed the amount you paid for the app in the twelve months preceding the claim, or USD $10, whichever is greater.
Some jurisdictions do not allow these limitations, in which case they apply only to the extent permitted.
6. Health and safety
If you experience hearing discomfort during use, lower the volume or stop the cycle immediately. Do not use the app at maximum volume with the speaker pressed against your ear. Do not use the app while operating a vehicle or in any context where the sound could disrupt awareness of your surroundings.
7. Termination
We may terminate or suspend access to the app at any time, without notice, for any reason, including breach of these terms. Upon termination your right to use the app ends and you should delete it from your devices. Sections 4, 5, 8, and 9 survive termination.
8. Governing law
These terms are governed by the laws of the Federative Republic of Brazil, excluding its conflict of laws principles. Disputes that cannot be resolved informally shall be brought exclusively in the courts of São Paulo, SP, Brazil, except where mandatory consumer protection law of your country of residence applies.
9. Changes
We may revise these terms from time to time. The “Last updated” date will reflect the most recent revision. Continued use of the app after revisions take effect indicates acceptance.
